care worker at elementary school. abc7 news, matt keller, has details. >> police say this alleged incident took place at the almostty school during after school program two weeks ago. this investigation is not over. police say on october 18, a friday, a man was sitting with an elementary age girl when he kited her and touched her. on learning of this, the district removed him from contact with children and provided information to the san mateo police department. he was arrested a week later on friday october 25 at his home and faces charge of lewd acts with a minor under age 14. police are trying to determine if he has other inappropriate contact with any other kids. anyone with information is asked to call the san mateo police department.

>> critics of the sheriff deputy handling with a 13-year-old boy carrying a pellet gun have troubling new piece of information this morning. katie marzullo, it is making some in santa rosa more angry. >> the police who are investigating the shooting say the sheriff deputy took only seconds after warning him to drop the gun. they are promising, now, more protests, vilifying the deputy, erick gelhaus. hundreds, maybe up to 1,500 rallied in santa rosa. they want justice and a fair investigation. the police want to be transparent so are releasing this information. >> the time between when the deputy told the dispatcher the oaks and when he advised on the radio shots were fired was ten seconds. >> i cannot understand how this happened in such a short, short

time, ten seconds and the boy is murdered. >> police say the deputy, erick gelhaus, yelled twice for him to drop the gun which he thought was a real ak-47. the boy turned to him with the gun and erick gelhaus fired eight times. a member of a protest group said there will be more protests. he does not know when. >> katie, thank you. >> in antioch we are following, four people are recovering after being attacked by two dogs. police say a man was walking his two dogs before 10:00 p.m. and two other dogs charged him from an open area. three neighbors her the screams and tried to help but they were attacked. officers arrived moments later and the dogs charged at the officers. they fired four shots killing

one dog. the other ran away buts with captured. all four people were taken to the hospital with bites to arms and hands. one was bitten in the face. abc7 news reporter, amy hollyfield, will have more from the scene. >> university of california president napolitano says that the school system is pledging $15 million to help students, $5 million to help those who legal illegally in the united states. the university officials estimate that out of the 239,000 students enrolled less than a thousand came to the country illegally as children. early in the day she spoke to students at oakland technical high school of the importance of a college education. >> students at city college of san francisco will march to the city hall from the campus today. they will deliver thousands of cards from community members to the mayor demanding the city college stay open.

they stand to lose accreditation in july because the commission says the school has not done enough to reform their financial policies and management. >> this morning, east bay regional park police are investigating a man's death after the body washed ashore in berkeley yesterday afternoon near interstate 80. the c.h.p. received a report at 3:30 of a possible bed on waterfront half a mile south of university avenue. there are no details of his identity or how he may have died. >> the lawyer for a marin county teen convicted of murder is calling for leniency, rather, for attempted murder, the 19-year-old max wade was found guilty accused of stealing a $200,000 sports car belonging to food network car guy fieri who testified against the defendant on monday. the attempted murder is because of a drive-by shooting of a gill and her boyfriend last year.

wade could face 30 years to life in prison when sentenced in december. >> the police chief is calling for a meeting with recruits to prevent new san jose officers from leaving the force after revelations up to half of the latest police academy graduate class is considering positions elsewhere. 5 percent of graduates have left. the leaders are suggesting retention plans including the possibility of charging officers for their training if they spent less than a year with the department. >> top executives the google are outraged that they and yahoo have been hacked by the n.s.a. according to the "washington post". the n.s.a. secretly broke into the main communications links connecting data centers around the world belonging to google and yahoo. the documents say the government intercepted 180 million records over the span of 30 days including e-mails and video and

in petaluma. i will have more details on that in a little bit. the altamont pass shows it is busy. a frightful sight indeed westbound. bumper-to-bumper traffic to highway 580 and into livermore it will be slow. you will not see relief until highway 84. as you come down this area here there is an area of heavy traffic at 20 miles per hour in the southbound direction. northbound into pleasanton to dublin interchange it is looking slow. back to highway 116, a car was reported that veered off the road at the highway and it caught fire and now it has caused brush to catch fire. right now we have traffic diverted at state gulch and highway 116 is shut down until further notice. that is the drive along 101

>> a bus driver in buffalo, new york, is called a horror -- call a "hero" after talking a woman 50 of a learn. he saw the woman on the wrong side of a guardrail and stopped the bus full of high school students and asked? she needed help. he got off the bus to talk to her. >> she was not looking at me. i was okay as long as we had eye contact. she turned around and started looking back down and it got urgent. at this point, i made my move, if you will. >> he pulled her to safety and sat on the sidewalk until help arrived. when he got back on the bus, the riders were cheering. >> if you are flying off for the holidays, you will find the lowest fare if you become before november 12.
